WeFix: Your Privacy Rights

This Supplemental Privacy Policy and Notice (“Supplemental Policy”) applies exclusively to information collected about consumers residing in California, Colorado, Virginia, Utah, or Connecticut (“consumer(s),” “Consumer(s),” “you,” “your”) and supplements the information contained in the WeFix Privacy Policy. It provides information required under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA”), the Colorado Privacy Act of 2021 (“CPA”), the Virginia Consumer Data Protection Act of 2021 (“VCDPA”), the Utah Consumer Privacy Act of 2022 (“UCPA”), and the Connecticut Data Privacy Act of 2022 (“CDPA”), including any implementing regulations.

This Supplemental Policy describes the practices of WeFix Appliance, LLC and its subsidiaries (“WeFix,” “we,” “us,” or “our”) regarding the collection, use, and disclosure of personal information and provides instructions for submitting data subject requests. Certain sections of this Supplemental Policy apply only to consumers in specific states, and we have indicated where those provisions are state-specific.

Definitions Specific to this Policy

  • “Consumer” means a natural person who resides in a state where WeFix operates, including: Florida, Texas, North Carolina, South Carolina, Tennessee, Colorado, Pennsylvania, New York, New Jersey, and Illinois, and to whom WeFix offers information, goods, or services. For purposes of this Supplemental Policy, this term also includes natural persons who interact with WeFix in the context of business-to-business transactions.
  • “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or household. Personal Information includes “personal data” as defined under the CPA, VCDPA, UCPA, and CDPA. Personal Information also includes Sensitive Personal Information, as defined below.

“Sensitive Personal Information” means Personal Information that reveals a Consumer’s:

  1. Social security number, driver’s license number, state identification card number, or passport number;
  2. Account login, financial account number, debit card number, or credit card number in combination with any required security or access code, password, or credentials allowing access to the individual’s account;
  3. Precise geolocation;
  4. Racial or ethnic origin;
  5. Religious beliefs;
  6. Union membership;
  7. Contents of email or text messages, unless WeFix is the intended recipient;
  8. Genetic data;
  9. Biometric information used to uniquely identify the Consumer; and
  10. Health information, sex life, or sexual orientation.

Sensitive Personal Information includes “sensitive data” as defined under the CPA, VCDPA, UCPA, and CDPA.

  • “Sell,” “Sale,” or “Sold” means renting, releasing, or transferring an individual’s Personal Information to a Third Party for monetary or other valuable consideration. WeFix does not sell personal information as defined under applicable laws.
  • “Share,” “Shared,” or “Sharing” means transferring an individual’s Personal Information to a Third Party for behavioral advertising purposes, whether or not for money or other valuable consideration.
  • “Third Party” means any person or entity that is not a Consumer, Vendor, or an entity owned or controlled by WeFix, as defined under the CCPA, CPA, VCDPA, UCPA, and CDPA.
  • “Vendor” means a “service provider,” “contractor,” or “processor” that collects, stores, or otherwise handles data on behalf of WeFix, as those terms are defined under the CCPA, CPA, VCDPA, UCPA, and CDPA.

These definitions apply regardless of capitalization. Other terms used in this Supplemental Policy may be defined in the CCPA, CPA, VCDPA, UCPA, or CDPA, and shall carry the meanings set forth in those statutes. In the event of conflicting definitions across these laws, the definition applicable to your state shall govern.

The Personal Information We Collect and Disclose

The table below identifies the categories of personal information that WeFix may collect; examples of personal information within each category; the sources from which each category of personal information is collected; the business purposes for which each category of personal information is collected; and the types of Vendors or Third Parties with whom that category of personal information may be shared.

As indicated in this table, WeFix may share or sell personal information to Third Parties or disclose certain personal information to Vendors for legitimate business purposes and may share for targeted advertising (which may constitute “sharing” under applicable laws).

Retention of Data

WeFix intends to retain each category of personal information described above only for as long as necessary to fulfill the purpose for which it was collected, or for a related and compatible purpose consistent with the reasonable expectations of the average consumer, and to comply with applicable laws and regulations.

In determining the appropriate retention period for personal information, WeFix considers factors including, but not limited to:

  • the purpose for which the personal information was collected;
  • the nature of the personal information;
  • the sensitivity of the personal information;
  • WeFix’s legal obligations related to the personal information; and
  • the risks associated with retaining the personal information.

Your Rights to Your Personal Information

Consumers residing in Florida, Texas, North Carolina, South Carolina, Tennessee, Colorado, Pennsylvania, New York, New Jersey, or Illinois have certain rights regarding the collection, use, and disclosure of their personal information. These rights may vary by state.

We honor Global Privacy Control (GPC) and other opt-out preference signals as valid opt-outs from sales/sharing/targeted advertising where required by law (e.g., CA, CO, CT).

You have the right to submit requests regarding the personal information WeFix has collected about you. You may submit such requests up to two times within a 12-month period. WeFix may be unable to comply with certain requests if your identity cannot be verified or if providing a full response would conflict with legal or regulatory obligations.

  • The categories of personal information collected;
  • The purposes for which each category of personal information is collected or used;
  • Whether personal information is shared with Third Parties or disclosed to Vendors;

Right to Delete

You have the right to request that WeFix delete certain personal information we have collected about you.

Right to Correct

You have the right to request that WeFix correct any inaccurate personal information we maintain about you.

Right to Opt-Out of the Sharing of Your Personal Information

You have the right to opt-out of the sharing of your personal information with Third Parties and the right to opt-out of the processing of personal information for targeted advertising purposes under applicable state law.

WeFix does not knowingly share personal information of consumers under 16 years of age.

Do Not Sell or Share My Personal Information

If you opt-out of the sharing of your personal information, WeFix will wait at least 12 months before asking whether you wish to share your personal information again.

You may opt back in at any time by contacting us at [insert WeFix privacy email] or calling [insert WeFix phone number]. Opting in requires a clear request followed by confirmation.

Right to Consent to or Limit the Use of Your Sensitive Personal Information

Consumers residing in Florida, Texas, North Carolina, South Carolina, Tennessee, Colorado, Pennsylvania, New York, New Jersey, or Illinois have the right to consent to the use of their Sensitive Personal Information.

California residents have the right to instruct WeFix to limit the use and disclosure of Sensitive Personal Information to what is necessary to provide goods or services reasonably expected by an average consumer or as required by law.

WeFix does not use Sensitive Personal Information for purposes beyond those authorized by applicable privacy laws or beyond your consent.

Right to Non-Discrimination

You may exercise your rights under this policy without facing discrimination.

Verification requirements may vary depending on the type of request. You may also submit a request via email at [email protected].

You may designate an authorized agent to exercise your rights on your behalf. Such an individual must have power of attorney or be an authorized agent registered with the applicable state authority.

Right to Appeal

You have the right to appeal decisions regarding your data subject requests. Appeals will be escalated to WeFix’s Legal Team for review. To submit an appeal call (727) 34-WEFIX, stating your request is an “Appeal” and providing the date and nature of your original request.

Verification Process

When you submit a request to exercise your data subject rights, WeFix may require you to provide information necessary to verify your identity.

If you designate an authorized agent to submit a request on your behalf, WeFix may require that you or the authorized agent:

  • Verify your identity directly with WeFix; and
  • Provide proof of signed written authorization permitting the agent to act on your behalf.

WeFix may deny a request from an agent if proof of authorization is not provided upon request.

Personal Information of Minors

Our online content is not intended for children or minors under the age of sixteen (16). WeFix does not knowingly collect or retain personal information from minors under sixteen, except as required by applicable law. If you believe a child has submitted personal information to WeFix, please contact us at [email protected], and we will delete the information.

Additional Florida, Texas, and Other State Privacy Rights

Certain states where WeFix operates provide additional privacy rights for residents. For example, California residents may submit a “Shine the Light” request under California Civil Code § 1798.83 to obtain information regarding the disclosure of their personal information to third parties for direct marketing purposes. Changes to Our Supplemental Policy

WeFix reserves the right to amend this Supplemental Policy at any time. Any changes will be posted on our website with the effective date indicated.
